Your data: Short-term Lets applications

How we use your information

Aberdeen City Council uses the information you provide to process your Short-term Lets application. This involves forwarding your application to Police Scotland and Scottish Fire & Rescue Service for their views. We will also use your contact details in order to contact you about your application and to keep you up to date with relevant information on short-term lets legislation and guidance.

Your application may be granted under delegated powers or may require a decision to be taken by the Licensing Committee.

If your application is considered by the Licensing Committee, the Council will share the information you, and any objectors to your application, have provided with the members of the Committee determining your application. The Committee meeting agenda, minutes and accompanying papers including limited details of your application, provided it was not deemed confidential, are published on the Council’s website indefinitely. If the Committee has deemed your application confidential and considered it in private, the minute which is published will be anonymised.

If you are making this application on behalf of another individual as their agent, or if you are applying on your own behalf but appointing another individual as agent, then this privacy notice will also apply to them. It is important that they also read this notice and we expect that you bring it to their attention.

How long we keep your information for

If your application is granted, the Council will keep your application and some supporting documentation, for three years after the expiry of your licence.  In the event your application is not successful, your application and related documentation will be retained for six years after the case is closed.

In addition, whether granted, withdrawn or refused a limited amount of your information will be added to the Short-term Lets register which is publicly available on the Council’s website.

Your rights

You have rights in relation to your data, including the right to ask for a copy of it. You also have the right to make a complaint to the Information Commissioner's Office if you think we haven’t handled your data properly.

Our legal basis

Wherever the Council processes personal data, we need to make sure we have a legal basis for doing so in data protection law. The Council understands our legal bases for processing personal data in relation to your Short-term let application as being part of our public task in that the Council is exercising its function under the Civic Government (Scotland) Act 1982 (Licencing of Short Term Lets) Order 2022.
