Your data: Fixed Penalty notice - littering

How we use your information

Aberdeen City Council asks you to provide information to allow us to issue a Fixed Penalty Notice in relation to a littering offence. If you do not comply with the notice your personal information will be shared with the Procurator Fiscal for potential prosecution.

How long we keep your information for

We will keep your information for six years from the date of compliance with the fixed penalty notice.

Your rights

You have rights in relation to your data, including the right to ask for a copy. You also have the right to make a complaint to the Information Commissioner’s Office if you think we haven’t handled your data properly.

Our legal basis

Aberdeen City Council is the Data Controller for the information you provide. Wherever we process personal information we have to make sure we have a basis for doing so in Data Protection Law. We understand our basis for enforcing penalty notices relating to littering offences as Article 6(1)(c) and 6(1)(e) of the General Data Protection Regulation. This is because we carry out this activity as part of our public task and as a legal obligation as a local authority to enforce the littering offences under the Environmental Protection Act 1990.
