Why are we asking for your information?

The English as an Additional Language Service supports multi-lingual pupils in Aberdeen City Schools. In order to assess and support your child most effectively, we will collect relevant information about your child. Any decisions about the help your child needs will be discussed with you. In some cases, information will be added to our records using automated processing, to speed up the time it takes to deal with simple processes. Decisions about your child are not made using automated decision-making. 

As part of Aberdeen City Council (ACC) we will only share information to get help for your child (apart from in child protection situations). We have an agreement with our partner agencies; Police Scotland, NHS Grampian, Moray Council and Aberdeenshire Council which governs how we share data. Our partner agencies are listed on our education website. This will give you further details of the information that we share with each partner.

How long we keep your information for

Throughout the time that your child, or young person is receiving support, we will keep records about the type of support they are given and the progress they are making. This information will be stored safely and securely, and we will keep it for 1 year from the date your child or young person leaves the service or date of last contact. We will keep collated data about how we support children so we can audit service provision.

Your rights

You’ve got legal rights about the way the Council handles and uses your data, which include the right to ask for a copy of it, and to ask us to stop doing something with your data.

You also have the right to make a complaint to the Information Commissioner’s Office. They are the body responsible for making sure organisations like the Council handle your data lawfully.

Our legal basis

Aberdeen City Council is the Data Controller for this information about you. Wherever the Council processes personal data, we need to make sure we have a legal basis for doing so in data protection law. The Council understands our legal basis for processing personal data in relation to the English as an Additional Language Service as part of our public task, under the Education (Scotland) Act 2016, Education (Additional Support for Learning) (Scotland) Act 2009 and the Children and Young People (Scotland) Act 2014. In carrying out this function, the Council is also likely to process special categories of personal data. The Council understands our legal basis for doing so because processing is necessary for reasons of substantial public interest.
