Your data: trade waste contracts

How we use your information

Aberdeen City Council collects this information about you in this form in order to provide and manage contracts.

The Council may be required to share parts of the personal information you provide with other Council business areas such as Finance, Waste Compliance and Environmental Health. We will also share personal information with an organisation we have contracted with for our Service Management Information System in order to aid the effective management of our waste and recycling collections and related administration. When a contract is agreed, we will issue a Waste Transfer Notice, which requires the gathering of personal information from whoever fills in the Notice. We will issue a new Waste Transfer Notice annually, and if there is any amendment to the contract. We will only share the information necessary to work towards and maintain a contract.

How long we keep your information for

We will keep data for the current financial year plus five years for contract related enquiries (including quotations) and for signed Trade Waste Agreements (from date of termination). Waste Transfer Notes have to be retained by law for two years (from their end date). Separately, our customers' financial data is kept for up to 6 years from the date of account termination. All records will be destroyed upon reaching the end of their retention period. In the event that information types are mixed within the same source, the retention period applied will reflect the longest related time period.

Your rights

Our legal basis

Aberdeen City Council is the Data Controller for this information. Wherever we process personal data we need to make sure we have a legal basis for doing so in data protection law. The council understands our legal basis for processing information relating to contracts as Article 6(1)(b) of the General Data Protection Regulation. Our basis for the processing and retention of Waste Transfer Notices is understood to be Article 6(1)(c) of the General Data Protection Regulation. This is because it is a legal obligation under the Environmental Protection Act 1990 and the Waste (Scotland) Regulations 2012.
