Non-Material Variations
Introduction
Once planning permission has been granted, there can be instances where the proposed scheme may require to be amended for any number of reasons. Such alterations if minor in nature may be able to be dealt with by submitting a request for a non-material variation. A non-material variation essentially means that the amendments proposed will not significantly change the scheme that was originally granted planning permission. Alterations that qualify as a non material variation are generally therefore minor changes.
In dealing with requests to allow non-material variations to planning permissions, the following criteria should all be met prior to agreeing that formal planning permission is not required:
| 1. | The request for non-material variation is made in writing and accompanied by a scaled plan with the variation clearly coloured |
| 2. | The request for a non-material variation is made prior to the applicable work being carried out and this is not retrospective |
| 3. | The proposed variation complies with the relevant Development Plan policies |
| 4. | The proposed change does not, itself, require formal planning consent, or Listed Building/Conservation Area consent |
| 5. | The proposed change does not, in itself, require neighbour notification |
Assuming the criteria have been met, the plans accompanying the request for variation shall be dated and clearly stamped. One copy shall be retained on file and one copy shall be returned. Should a request for non-material variation fail to meet any of the above criteria then a planning application should be requested. The new application would then be determined in the normal manner, either by delegated powers by officer or by the Development Management Sub-Committee. Please note that officers can only deal with requests for a non-material variation for planning applications.
