Environmental Information - Regulations

The Environmental Information (Scotland) Regulations 2004 (EISR) replace the Environmental Information Regulations 1992 which gave the public the right to ask for information which ‘relates to the environment’ and which was held by a ‘relevant person’.

The 2004 Regulations provide public access to environmental information held by a range of bodies including the Council. The Regulations are similar in structure to the Freedom of Information (Scotland) 2002 Act (FOISA), however they cover different types of information.

Technically, all information covered by the EISR is exempt from FOI requests, but in practice this simply means that the request must be processed under these Regulations rather than under FOISA. The distinction only has practical significance in relation to operational timescales and the discretionary fee charging system.
